1. Use of Service

  • BGoneer provides an AI-powered background removal service for images.

  • You agree to use the Service only for lawful purposes and in compliance with these Terms.

  • You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement.

2. Account and Registration

  • Certain features require creating an account.

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.

3. User Content

  • You retain all rights to the images and files you upload.

  • By uploading files, you grant BGoneer a limited, non-exclusive, royalty-free license to use, process, and store your files solely to provide the Service.

  • You represent and warrant that you have all rights necessary to upload and process the files and that your use complies with applicable laws.

4. Prohibited Content and Uploads

You must NOT upload any content or files that:

  • Contain illegal material or violate any applicable law or regulation.

  • Depict or promote child exploitation, abuse, or any form of human trafficking.

  • Include pornography, sexually explicit or adult content, or any content inappropriate for minors.

  • Contain violence, gore, hate speech, or content promoting terrorism or discrimination.

  • Include viruses, malware, spyware, or any malicious code intended to disrupt or harm the Service or other users.

  • Infringe on intellectual property rights or privacy rights of others.

  • Are fraudulent, deceptive, or intended to impersonate any person or entity.

We reserve the right to immediately remove or block any content that violates these rules and to suspend or terminate accounts responsible for prohibited uploads.

5. File Handling and Data Retention

  • Uploaded files are processed and automatically deleted immediately after processing is completed.

  • We do not store, share, or use your files beyond providing the Service.

6. Subscriptions and Payments

  • Access to some Service features may require a subscription or one-time payment.

  • Subscription fees are billed in advance on a recurring basis as per the selected plan.

  • You authorize us to charge your chosen payment method for the subscription fees and applicable taxes.

  • You are responsible for providing accurate payment information and for any charges incurred.

7. Refund Policy

  • All payments and subscription fees are non-refundable.

  • We do not offer refunds, credits, or cancellations for partially used subscription periods or unused features.

  • Exceptions may be made only at our sole discretion and in accordance with applicable law.

8. Prohibited Uses

You agree not to:

  • Use the Service for any illegal, harmful, or fraudulent purposes.

  • Attempt to gain unauthorized access to our systems or disrupt the Service.

9. Disclaimers and Limitation of Liability

  • To the maximum extent permitted by law, BGoneer and its affiliates disclaim all liability for damages arising out of or related to your use of the Service.

  • In no event shall our total liability exceed the amount you paid us in the 3 months prior to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless BGoneer, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your breach of these Terms or your use of the Service.

11. Dispute Resolution and Governing Law

  • These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of laws principles.

  • You agree to resolve any disputes arising out of or relating to these Terms exclusively through binding arbitration conducted by the American Arbitration Association under its Commercial Arbitration Rules.

  • Arbitration will be conducted in English, in San Francisco, California, unless otherwise agreed.

  • By agreeing to arbitration, you waive the right to a jury trial or to participate in class or representative actions.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
